- Abstract
The Liability Risk Retention Act of 1986 was enacted quickly by Congress without the benefit of a substantial period to debate the ramifications of the legislation. The result, according to the author of this article, is an act that strengthens state regulatory authority in some instances, preempts it in others, leaves regulation untouched in some cases, and creates a regulatory void in others. He analyzes Congressional intent, offers insights into approaches for determining permissible areas of activity, and documents the extensive legislative history of the Act.
