- Abstract
Consumers and governments inevitably pay the price for the lack of available and affordable insurance. The author urges that the best method to combat this problem is by pooling similar risks of related entities for self-interest, mutual dependence, and mutual indemnification. He believes that the United States Risk Retention Act, as amended, provides an excellent framework for forming association captives in both developed and developing countries, describes the analysis that should precede such action, and provides a checklist to guide organizers of such captives.
