- Abstract
In th e course of an assignment a professional appraiser (like many other professionals) may retain a variety of information, including notes, charts , spreadsheets, letters , emails, and other documents to support the execution and completion of an assignment. In the event of litigation, professional appraisers must recognize that with few exceptions this information may be discoverable, i.e ., made available to a party, even if the appraisal is not the subject of a lawsuit. This article reviews the discovery process, the likelihood that documents in the professional's work file may be discoverable, and how the law on discovery impacts the professional appraiser. This article does not examine issues related to appraisers providing expert testimony or the liability exposure appraisers possibly face if work file information is sought by a third party.
