- Abstract
From 2009 a decrease in adoptions of children due to difficulties in their procedures, the use of methods of assisted reproduction and public policies contrary to the interests of the child is evident. This generates an institutionalization that affects in particular children who are against the passage of time, as each day involves a wait for families who have lost interest in adopting hem. In Colombia, these difficulties were increased following the ruling of the Constitutional Court T-844 de 2011, which gave the basis for an interpretation by the ICBF in the sense of advancing the search until the sixth grade of consanguinity of the family of child's origin, reducing adoptions by 62%. As a result you have it that children belonging to groups of siblings with disabilities and older than eight years are considered difficult adoptability turning them into children of the State, under the uncertainty about future possibilities and social marginalization as a result of institutionalization. This article 'presents the progress of the research "Adoption of children in Colombia and its difficulties in administrative and judicial practice" where the challenge the State must take to protect these children is exposed, acting as a "family" that tries to fill the gaps that are found in a State institution.
