- Abstract
The course pretends to give a historical view and the actual regulation of the Spanish nationality as well as the problems arisen from the decolonization. Though the mentioned rules were included in the text of the Constitutions, a rupture from this tradition was produced. Since the promulgation of the Civil Code of 1889 there existed successive reforms, either globally or partially, to adapt the regulation to new realities. The main object of the Law 51/1982 was to adapt the nationality rules to the 1978 Constitution, however, many interpretation problems appeared. The Law 18/1990 intended to rectify the deficiencies, gaps and contradictions observed due to the denounced experience; some new institutions were introduced by the legislative text. The 2002 Law eased the rules in order to maintain and to transmit the Spanish nationality so to safeguard Spanish workers' rights abroad. A new possibility of having right to opt for Spanish nationality was incorporated through the Law 52/2007. In spite of successive reforms, the Spanish system of nationality depends on the fact that Spain was a migrating country though nowadays there is an increasing influence to the autonomy principle of self's will and a retraction on the principles of family dependence and penalization on naturalization and loss of nationality.
