- Abstract
One of the most important and most frequently used jurisdictions of the Constitutional Court of Bosnia and Herzegovina is appellate jurisdiction. With the introduction of this jurisdiction, the citizens of Bosnia and Herzegovina were given the opportunity to apply to the Constitutional Court of BiH and to request the protection of their constitutionally guaranteed rights and freedoms. This jurisdiction was established by a rather vague provision that reads "The Constitutional Court shall also have secondary jurisdiction in matters covered by this Constitution when they become the subject of a dispute over the judgment of any court in Bosnia and Herzegovina." The cited constitutional provision does not clearly define the content of the said jurisdiction, it does not specify who can appeal and against which acts. The answers to these and other contentious questions were provided by the Constitutional Court of BiH itself. Constitutional Court of BiH further specified the aforementioned jurisdiction with its Rules, as well as with its decisions through which the subject of appeal in our legal system was determined. This paper will analyze the normative framework but also the practice of the Constitutional Court itself, which also defined the "subject" of the appeal before the Constitutional Court of BiH.
